New State "Emergency" Powers Threaten Civil Liberties Unelected Officials Can Force Vaccinations, Quarantines, Rationing & Property Seizures
December 13, 2001 -- The U.S. Department of Health and Human Services is sending a model bill for state legislatures to pass that would give public health officials and governors sweeping new authority to quarantine and vaccinate individuals. Moreover, the proposal allows government authorities to ration and commandeer drugs and other items, including firearms and private property.

This bill would give the governor the power to declare himself dictator in case of a "public health emergency" -- which means whatever he says it does. Further, the governor could then delegate this authority to unelected political appointees in state and local public health offices.

The bill is so alarming that even state legislators are publicly opposing it, including the American Legislative Exchange Council (ALEC), the nation's largest bipartisan, individual membership organization of state legislators.

While ALEC's Director of the Health and Human Services Task Force acknowledges that safeguarding citizens from biological and chemical attack is a critical function of government, "We must take a much more deliberative approach in crafting effective policy without sacrificing the rights and liberties of individuals and families," said Jennifer King.

The proposed legislation, entitled the Model State Emergency Health Powers Act (MEHPA), is already under consideration in several states including Maryland, Massachusetts, Nevada, Minnesota, Illinois, and California, while many states will consider the measure during the 2002 legislative sessions, according to King.

Upon declaring an emergency, the government could:
Force you to take a vaccination or a medical treatment decided by the Governor -- or be arrested;
Herd you into a public quarantine or isolation facility;
Seize any of your property that the government decided was necessary to cope with the emergency, such as real estate, fuel, food, clothing, and communication devices;
Destroy property alleged to be hazardous without compensation and without recourse;
Conscript you or your business into State service;
Impose rationing, price controls, and quotas, and control the transportation or use of any item deemed "reasonable and necessary for emergency response," specifically including firearms; and
Suspend any State rules that might hinder the program.
The Governor does not have to consult the public health authority, the legislature, or the courts. He does not have to answer to anyone, ever, for the consequences of his actions. HHS will probably try to bribe or coerce the legislature into passing this law by threatening to withhold federal funds for state Medicaid or other health programs.

Here it is! The text for the Pennsylvania Model State Emergency Health Powers Act! I've changed NO language here. I DID bold and highlight words, phrases, etc. that need attention.

The Public Safety Authority here is the Pennsylvania Emergency Management Agency. It's called PEMA here. On the Federal level it's called FEMA and at the world level it's called GEMA - Global Emergency Management Agency. It is as I suspected in reading the CDC/WHO/UN draft bill. They intend to implement the FEMA presidential E.O.s at the state level.

PEMA is intended to be the enforcement arm of the orders given by the "Public Health Authority" or the orders of a "person" designated to act on behalf of the Public Health Authority. A person. An individual. One person. How does that sound? Feel? Fit with your sense of true freedom and liberty? A PERSON.

"Guided by the principles of justice it is the duty of the Commonwealth to act with fairness and tolerance toward individuals and groups." Notice they do not intend to be guided by the Constitution/Bill of Rights. Neither the U.S. Constitution nor the Constitution of the Commonwealth of Pennsylvania is mentioned in this Act.

HB2261 is amending the Administrative Code of 1929. I was fooled, in that I thought they would be amending the current Public Health Acts. Maybe that's part of the Administrative Code. Haven't read it yet.

The emergency plans are intended to be carried out by "rules and regulations promulgated by bureaucrats and agents of the several agencies". Anyone who has ever had to deal with a bureaucrat (they made me nuts when I owned and operated a business) realizes that they are an integral part of the plan for World Dominion.

Brainless, heartless, and non-thinking, they are immune from any harm caused by their actions. Most are small minded, mean minded idiots and their greatest joy is to cause hardship for others. Many of the high-level bureaucrats are born, bred and educated for the job. There is no common sense, no compassion, nor any regret for the mental anguish (abducting children from parents) theft of property or financial loss they cause a person or group of people. POWER is the name of their game, and they revel in their unbridled power. Lower level bureaucrats are nearly as dangerous. And those who are the least compassionate, who carry out orders without a blink are the ones who move quickly up the bureaucratic ladder.

Hopefully within the next couple of days we can put together a two-page summary on this with comments and 'talking points' for state legislators. I was told today that Representative Sturla, the 'sponsor' of the bill had made a statement - paraphrasing here - that he couldn't understand the concern about this thing because it would be stripped down in committee. Don't count on it! The legislators have already been told to "support HB2261 because it's an 'anthrax bill'. NOT.

The neverending war is a weapon of mass distraction... keeping everyone's eye's, ears, attention and time riveted on the hundreds/thousands of details of the 'war', while all the time the war was planned to do what unConstitutional legislation like HB2261 could do if passed.
